Who Should Not Apply for a Permanent Resident Travel Document (PRTD)?
You should not apply for a Permanent Resident Travel Document if you fall into one of the following categories:
- Canadian Citizens: You do not need a PRTD as Canadian citizens are not required to use this document.
- Foreign Nationals Without Permanent Resident Status: Individuals who are not
permanent residents are ineligible for a PRTD. - Permanent Residents with a Valid PR Card: If you already have a valid Permanent Resident (PR) card, you do not need a PRTD.
- Permanent Residents Currently in Canada: If you are in Canada, you do not need a PRTD for travel.
- Permanent Residents Who Wish to Renounce Their Status: Those who want to
voluntarily give up their PR status should not apply for a PRTD. - Former Permanent Residents Who Have Lost PR Status: Individuals who have
previously lost their PR status are not eligible for a PRTD.
Requirements for Applying for a PRTD:
To apply for a Permanent Resident Travel Document, you must:
- Verify Your Identity: Provide proof of who you are.
- Confirm Your PR Status: Show evidence of your status as a permanent resident.
- Meet the Residency Obligation: Fulfill the physical presence requirements for
permanent residents.
Residency Obligation
Calculating Your Days in Canada:
- If You Have Been a Permanent Resident for Five Years or More: You must have been physically present in Canada for at least 730 days within the five years immediately preceding your PRTD application.
- If You Have Been a Permanent Resident for Less Than Five Years: You need to demonstrate that you will accumulate a minimum of 730 days of physical presence in Canada within the five years from the date you became a permanent resident.
- Exceptions Apply: If you are working a Canadian Employer or are living a spouse who is a Canadian Citizen outside Canada, you will meet the residency requirement despite not having physical days inside Canada. These exceptions are very to prove and rarely given. Make sure to get legal advice from Fateh Law Corporation before proceeding with any exception ground.
Humanitarian and Compassionate Grounds
If you cannot meet the residency requirement, you might still be able to retain your PR status on humanitarian and compassionate grounds. To have your application considered under these grounds, you must:
- Complete the Application Form: Answer question 19 on the application form.
- Provide Evidence of Exceptional Circumstances: Show compelling humanitarian and compassionate factors that justify maintaining your PR status despite not meeting the residency obligation. A Canadian Affidavit drafted by an experienced Immigration Lawyer (Barrister) can go a long way in increasing your chances of success and avoiding a refusal.
- Explain Your Situation: Describe why you were unable to fulfill the residency requirements and the extent of any hardship losing PR status would cause:
- To yourself.
- To family members directly affected.
- To any children whose best interests would be impacted, if applicable.
While there are no specific guidelines for supporting documents, you should include any relevant documents and information that illustrate your exceptional circumstances. An immigration officer will review your case and make a decision based on the details and evidence provided in your application. We highly recommend that you submit your PRTD Application along with a Canadian Affidavit and legal submissions to increase your chances of success.

- Critical Family Situations: If you need to travel urgently due to a family emergency, such as the death or severe illness of a close family member, you should request urgency and provide relevant documentation, like a medical certificate or a death certificate.
3. Pending Employment or Business Obligations:
- Urgent Work Commitments: If your travel is related to urgent work commitments or business obligations, you can request expedited processing by providing documentation from your employer or business outlining the necessity of your immediate travel.
4. Humanitarian Reasons:
- Exceptional Circumstances: In cases where you face exceptional or extraordinary circumstances that necessitate urgent travel, you can request expedited processing. Document your situation thoroughly to demonstrate the need for urgency.
How to Request Urgency
1. Submit a Written Request:
- Include in Your Application: When applying for a PRTD, include a formal written request for expedited processing. Clearly state the reasons for your urgency and provide supporting documentation.
- Detail the Circumstances: Explain why you need urgent processing and how the situation impacts you. A Canadian Affidavit and legal submissions can be extremely helpful in making your request for urgency.
2. Provide Supporting Documentation:
- Medical or Family Documents: Include any relevant medical records, family emergency documentation, or employer statements that justify your request for urgency.
- Evidence of Exceptional Circumstances: Provide any additional evidence that supports your claim for expedited processing.
3. Follow Up:
- Contact Immigration Authorities: After submitting your request, follow up with the immigration office to ensure your request is being processed. This can help expedite the handling of your application.
4. Check Processing Times:
- Verify Urgency: Understand that while you can request expedited processing, it is up to the immigration authorities to determine if your request qualifies for urgent handling.
